Luv My Doodle Health Guarantee and Agreement
This Health Guarantee is an agreement between Luv My Doodle ("Breeder") and Buyer ("Family"). By purchasing a puppy from Luv My Doodle, the Buyer acknowledges and agrees to the terms outlined in this Health Guarantee.
1. Puppy Readiness for New Home
- Puppy Age at Transfer: Luv My Doodle determines the appropriate time for a puppy to leave our care based on health and readiness, typically between 8-12 weeks of age. The exact timing is based on the puppy's weight and how well it is weaned from the mother. We will not release the puppy before it is fully prepared.
2. Spay/Neuter Agreement
- PET ONLY Agreement: All puppies sold by Luv My Doodle are sold as pets only, under a strict spay/neuter agreement. It is required that the puppy be spayed or neutered between 12-18 months of age or per the guidance of the buyer's veterinarian. Documentation of the procedure must be submitted to Luv My Doodle at luvmysheepadoodle2@gmail.com within 30 days after the procedure is completed. Failure to do so voids this Health Guarantee.
3. Health Guarantee at Transfer
- The puppy is guaranteed to be in good health at the time of adoption or delivery and is free from contagious diseases upon transfer. The puppy will be up-to-date on vaccinations and deworming appropriate for their age at the time of pickup.
4. Buyer’s Veterinary Examination
- Examination Requirement: The Buyer agrees to have the puppy examined by a licensed veterinarian within 72 hours of receiving the puppy. This examination is essential for the Health Guarantee to remain valid. If the puppy is not examined within this time frame, the guarantee is void.
- Health Issues: If the puppy is found to be seriously ill by the veterinarian, the Buyer must provide a written report from the vet confirming the illness, and the puppy may be eligible for a replacement or refund. Any requests for a return must be made within 72 hours of receiving the puppy.
5. Health Guarantee Documentation
- All documentation related to any health issues must be provided to Luv My Doodle within 10 days for the Health Guarantee to be honored. This includes vet reports, diagnoses, and any other relevant medical documentation.
6. Refunds and Replacements
- Refund/Replacement Conditions: If a licensed veterinarian deems the puppy unhealthy within 72 hours, the puppy may be returned for a full refund, provided the puppy has not been injured, neglected, or exposed to any harmful conditions. A written statement from the veterinarian indicating the puppy’s “unhealthy for purchase” status is required.
7. Exclusions from Health Guarantee
- This guarantee does not cover:
- Health issues caused by buyer negligence, injury, or failure to provide proper care.
- Common conditions such as colds, allergies, parasites, giardia, coccidiosis, or minor health concerns like umbilical hernias, improper bites, or innocent heart murmurs.
- Bloat, hip dysplasia, cataracts, or any other conditions common to large breed dogs or Poodle, Bernese Mountain Dog, or Sheepdog-related genetic issues after the puppy leaves Breeder’s care.
8. Buyer’s Care Responsibility
- Proper Care: The Buyer assumes full responsibility for the care and well-being of the puppy after receiving it. The Buyer agrees to provide proper nutrition, regular veterinary care, exercise, and training to ensure the health and happiness of the puppy.
- Liability for Injury or Neglect: Luv My Doodle is not responsible for any injury, harm, or illness caused to the puppy by neglect, accidents, or improper care by the Buyer.
9. Training and Behavior
- The Breeder does not guarantee the puppy's behavior or training outcomes. While early socialization and training are provided, it is the responsibility of the Buyer to continue with training and behavior management. The Breeder is not liable for any behavioral or training difficulties that arise after the puppy has left our care.
10. Size and Growth
- Size Disclaimer: The Breeder does not guarantee the adult size of the puppy. While we provide an educated estimate based on the parents’ weights, size is influenced by many factors beyond genetics, including environment, diet, and health.
11. Genetic Health Guarantee
- One-Year Genetic Health Guarantee: Luv My Doodle offers a one-year guarantee against serious genetic defects that affect the puppy’s quality of life. If a congenital defect is diagnosed by a licensed veterinarian, the Buyer must return the puppy to the Breeder. Upon receipt of a written statement from the veterinarian confirming the genetic defect, the Buyer is eligible for a replacement puppy (from a future litter, subject to availability) or a refund of the purchase price.
- Both the sire and dame of the puppy are genetically tested for hereditary diseases common to their respective breeds (Standard Poodles, Bernese Mountain Dogs).
12. Return and Rehoming Policy
- First Right of Refusal: If, for any reason, the Buyer can no longer care for the puppy, they agree to return the puppy to Luv My Doodle. The Breeder has first right of refusal and must approve any rehoming arrangement.
- 30-Day Return Policy: If the puppy is returned within 30 days, a 50% refund will be given, provided the puppy is in the same condition and has not been neglected. The Buyer is responsible for all transportation costs. The remaining 50% will cover re-advertising fees, and the cost of vaccinations and deworming during the rehoming process.
- After 30 Days: No refunds will be issued after 30 days. However, the Breeder will assist in finding a suitable, loving home for the puppy.
13. Legal Fees
- In the event that legal action becomes necessary to enforce this agreement, the Buyer agrees to be responsible for all legal fees, including but not limited to attorney fees and court costs, incurred by the Breeder.
14. Limitation of Liability
- The Breeder’s liability is limited solely to the purchase price of the puppy. The Breeder is not liable for any incidental, consequential, or indirect damages arising from the puppy’s health, behavior, or any other issue.
